USER ACCESS TERMS:
NZ Radiology Group Ltd (NZRG) trading as Mercy Radiology Group (MRG) has created a remote access information system for use by Authorised Personnel for the ultimate benefit of their patients.
Patient confidentiality and privacy entitlements are such that access to patient medical Information must be restricted to Authorised Personnel for patient-specific Medical Treatment Purposes only and not for Unauthorised Purposes. MRG is also concerned to protect the technical integrity of the System.
Without exception, every User must comply with the User Access Terms. By accessing the System, the User agrees to be bound by the User Access Terms.
All persons accessing the System do so on the above basis, and as a further condition of access, agree:
- To take reasonable steps to verify the correctness and completeness of the Information and to advise MRG immediately if any such Information appears to be incorrect or incomplete.
- Not to seek access to any Information other than Information specifically relating to the relevant patient.
- To protect MRG and the System against viruses and unauthorised access.
- Not otherwise to act in a manner that might reasonably be expected to place at risk the System or its technical integrity.
- That MRG, its officers, employees, agents and contractors shall have no liability to any User in relation to the System or its availability regardless of the damage the User may suffer or of the cause of such damage.
- To indemnify MRG, its officers, employees, agents and contractors against any loss, damage or liability as such person may suffer as a result of the User's use of the System, whether or not resulting from failure to comply with the User Access Terms.
- To comply with all laws (including statutes, regulations and codes) and ethical obligations that pertain to the System, the Information or the privacy thereof and not to do anything that might cause MRG to contravene any such laws or obligations.
- That MRG may conduct a regular audit of any or all access to the System for the purpose of monitoring the usage of the System and compliance with the User Access Terms.
- To assist MRG with any review or audit it wishes to conduct in relation to the System or access to it.
- That MRG at its sole discretion may at any time modify the System or suspend or terminate access rights without notice to any person or association of persons and without being required to provide reasons.
- That the User reaffirms the User Access Terms each time the User enters the System.
- That the System is provided on an "as available" basis and that MRG does not warrant that access to the System will be continuous, timely or fault free.
- That MRG has no responsibility for the corruption of any data or Information and that MRG does do not warrant that the server that makes the Information available to the User is free of viruses or other harmful elements.
For clarity, the following definitions apply:
Authorised Personnel means medical practitioners and their support personnel advised to MRG from time to time who have been authorised by MRG to access the System and who have been allocated personal password access. (Where appropriate, the term "medical or other health practitioner" shall include practitioners associated with the accessing practitioner.)
System means the remote access information system which holds the Information and which is made available by MRG for access by Users.
Information means all information held in the System.
Medical Treatment Purposes means, in relation to a patient, diagnosis and treatment in the ordinary course of business by that patient's medical or other health practitioner as authorised and intended by that patient.
Unauthorised Purposes means any purposes other than Medical Treatment Purposes (including the reproduction in any form of Information, other than for entry in the same form as appears on the Facility and on a confidential basis into the patient's Information).
User means any person who accesses the System.
User Access Terms means these user access terms or such additional or replacement terms as MRG may from time to time adopt by inclusion of the same on www.radiology.co.nz.
